Privacy Policy

This Privacy Policy describes how personal information is collected, used and stored by LEADCALCULATORS INC. (“LCINC” or “we” or “us” or “our”) through use of the LeadCalculators platform, and through use of our websites and web-based resources (collectively, the “Services”).

Please read this Privacy Policy carefully. By accessing and using our Services, you consent to the collection, use, disclosure, and retention of your personal information as set out in this Privacy Policy. This Privacy Policy is a part of our Terms of Use, so by accepting the Terms of Use you are also consenting to the use and disclosure of your personal information as outlined in this Privacy Policy.

In this Policy, we use the word “Subscriber” to refer to anyone who has subscribed to and paid for use of our LeadCalculators platform. We use the word “you” and “your” to refer to any individual user of our Services.

Personal Information

"Personal information" means information about an identifiable individual that allows someone to identify or contact you, including, for example, your mailing address, telephone number, or e-mail address.

Collection of Your Personal Information

LCINC collects personal information in order to provide our Services, including: (a) to contact and correspond with you regarding your transactions and your use of our products and services; (b) to provide you with information regarding our announcements, promotions, upcoming events, new products, and special features; (c) to facilitate transactions and process orders and payments; (d) to process and respond to your specific suggestions, comments, inquiries and requests, and to otherwise administer our relationship with you; (e) to personalize and improve your experience while using our Services; (f) to create and manage your account; and (g) to develop, deliver, and improve our products, services and advertising.

Information We Collect from You:

Contact Information. We collect your contact information, such as your name, email address and organization, when you fill out our online forms or set up your user account for our Services.

Billing Information. When a Subscriber subscribes to our Services, we also ask them to provide credit card information to process payments. We do not keep your credit card information. Credit card information is provided directly to our payment processor which is PCI-compliant.

Log and Device Information. When you access and browse our Services, we collect information about how you are accessing our Services, such as your internet or mobile network connection, your browser or the type of mobile device you are using.

Cookies and Tracking Information. Our website uses cookies. Cookies are small data files that are downloaded to your computer or device by a website. Your web browser lets you manage cookies through its “settings” or “options” menus. You can change your browser settings to display a warning before accepting a cookie or to refuse all cookies other than essential cookies required for the functioning of the Services. You can also delete cookies at any time; however, please note that certain cookies must remain in order to use certain portions of the Services. We also use web beacons, which are tiny graphic objects embedded in a web page or an email which allows us to determine if a user has viewed the web page or email.

Subscriber Data. “Subscriber Data” means all information provided by an individual to a Subscriber or otherwise received and collected by a Subscriber during the course of using the Services and may include sensitive information such as personal health information (PHI). Subscribers are responsible for ensuring that their collection and use of Subscriber Data complies with applicable laws and regulatory requirements, including obtaining appropriate consent for collection, use, and disclosure of personal information.

LCINC’s Role Regarding Subscriber Data. LCINC is a service provider to Subscribers. LCINC will have access to Subscriber Data to address technical problems affecting the Services; in order to investigate or prevent fraud; or if required to do so by law, regulation or court order. LCINC may use computer-generated algorithms to gather anonymous and aggregated information from Subscriber Data in order to assist in our continued development and improvement of the Services, and for the purpose of analysis or compiling statistical data. We will ensure that such anonymized information is not shared outside of LCINC without the consent of the Subscriber, but we are permitted to share aggregated analysis about the use of the Services.

Disclosure of Your Personal Information

We do not sell or distribute personal information to third-parties for their own commercial or marketing purposes. We will only share personal information we collect in the following circumstances:

Suppliers and Service Providers. We may disclose the information we collect with service providers who assist us in operating our Services and conducting our business, for example website hosting partners, payment processing services, customer communications, data processing and data management, marketing, and advertising services. We require our service providers to agree to use your personal information only for the purposes for which it is provided to them, and to protect the privacy of your personal information in a manner that is consistent with this Privacy Policy. Our service providers may have their own privacy policies and we encourage you to review their respective privacy policies.

Compliance with Laws. We may disclose your personal information if required to do so by law or subpoena. If we are required to disclose personal information without your consent, we will not disclose more information than is minimally required in the applicable circumstances.

Anonymized / Aggregated Data. We may use computer-generated algorithms to gather anonymous and aggregated information from Subscriber Data in order to assist in our continued development and improvement of the Services, and for the purpose of analysis or compiling statistical data. We will ensure that such anonymized individualized information is not shared outside of LCINC without the consent of the Subscriber, but we are permitted to share aggregated analysis about the use of the Services.

Retention, Location, and Protection of Your Personal Information

We will retain your personal information for as long as it remains necessary or relevant for the purposes we have identified in this Privacy Policy or as permitted/required by applicable law.

We will store and process your personal information in Canada and the United States. The laws regarding the collection, use, disclosure, and retention of personal information may be different from the laws of your country.

Security

We take reasonable measures, including firewall barriers, SSL/TLS encryption techniques, and authentication procedures, to help protect personal information from accidental loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction.

While we employ industry standard measures to protect your information, no electronic communication can ever be completely secure. You share responsibility for protection of your personal information by utilizing the security features available to you and according to your needs.

Legal Basis (GDPR EU/UK)

For personal information that is subject to the General Data Protection Regulation (GDPR), we rely on the following legal bases for collecting and using your personal information:

  • Your consent.
  • The performance of the contract between the Subscriber or user and us.
  • Our legitimate business interests related to the Services, such as understanding and improving our Services, direct marketing related to our Services, communicating with Subscribers and users about our Services, events or related resources, improving our website, and protecting our legal rights and interests.

You may withdraw your consent at any time. Where we are using your personal information for our legitimate interests, you have the right to object to that use. See below under Your Rights for how to withdraw consent or object.

Legal Basis (HIPAA Compliance)

If we process protected health information (PHI), we comply with the Health Insurance Portability and Accountability Act (HIPAA) to protect your health data. In accordance with HIPAA, we:

  • Use PHI only for purposes related to our Services.
  • Ensure that PHI is not disclosed to unauthorized individuals or organizations.
  • Implement appropriate safeguards to protect the confidentiality and security of PHI.
  • Limit access to PHI to only those employees or third-party providers who need it to fulfill their duties.

Personal Information of Minors

LCINC does not knowingly collect personal information from minors. Please immediately contact us at the email address noted below if you believe that we have unintentionally collected personal information from a child under 18 years of age. If we learn that we have inadvertently collected the personal information of a child under 18 years of age, we will use reasonable efforts to delete that information from our systems.

Other Websites/Online Services

Our website may include links to other websites and provide access to products and services offered by third-parties, whose privacy policies we do not control. When you access another website or purchase third-party products or services through our website, use of any information you provide is governed by the privacy policy of the operator of the site you are visiting or the provider of such products or services.

Your Rights

Individuals have certain rights with respect to their personal information. These rights are set out below.

Correction and Deletion. We will make reasonable efforts to ensure that the personal information we collect from you is accurate and complete. You may update, correct or delete your account information at any time by logging into your user account and modifying your personal information, including your preferences to receive messages from us. You may also update, correct or delete your personal information by contacting us as noted below.

Withdrawing Consent. Where we have relied on your consent to use your personal information, you have the right to withdraw that consent at any time by contacting us as noted below, which we will give effect to promptly. In addition, all our marketing email messages contain the ability to automatically “opt-out” or unsubscribe from our mailing lists and marketing messages.

Access and Portability. You have the right to request a record of the personal information that we have collected about you and to ask that the information be provided in a structured, used electronic format (where applicable and technically feasible). There may be some cases where we cannot provide you with certain information about you if it would mean disclosure of personal information of another person or other confidential information, or if it would compromise our security systems. If you require access to your personal information, please contact us.

Restriction and Objection. In certain limited circumstances, you may request that we restrict our use of your personal information and, where we rely on legitimate interests as the legal basis for using your personal information, you have the right to object to such use. In these cases, we can be required to no longer use your personal information; however, this may mean that certain components of our Services cannot be made available to you.

Complaints. You have the right to lodge a complaint with a supervisory authority (i.e., the independent public authority responsible for monitoring data protection laws in your country).

Policy Changes

This Privacy Policy is subject to change at any time. If we make changes to this Privacy Policy, such changes will be posted here. Your continued use of the Services indicates your acceptance of the Policy.
